1. OVERVIEW
1.1 This website is operated by Kiana Celeen. Throughout the site, the terms “we”, “us” and “our” refer to Kiana Celeen. Kiana Celeen offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
1.2 These Terms will apply to any contract between us for the sale of Products to you (Contract). Please read these Terms carefully and make sure that you understand them, before ordering any Products from our site. Please note that before placing an order you will be asked to agree to these Terms. If you refuse to accept these Terms, you will not be able to order any Products from our site.
1.3 Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

2. GENERAL TERMS
2.1 The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
2.2 You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to the technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
2.3 You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
2.4 We reserve the right to refuse service to anyone for any reason at any time.
3. ONLINE ORDER TERMS
3.1 All products listed on www.kianaceleen.com that are in stock are dispatched within 1 – 3 working days, please refer to the product description to know how long it will take to process your order before its dispatch.
3.2 Some of our items are listed on www.kianaceleen.com on a pre-order or made-to-order basis, we ask for between 1-15 working days depending on the product for all deliveries to be made. Please refer to the product description for specific details of how long shipping will take. If there are any delays in the dispatch of your item we will do our best to notify you via email. If the pre-order item you have ordered has sold out we will refund you as soon as possible. For any items marked ‘pre-order’ please allow an extra 7 – 15 days for delivery. For all purchases from any of the products stocked on our site, your data will be passed onto them accordingly to fulfil your order.
3.3 You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
3.4 You must not transmit any worms or viruses or any code of a destructive nature.
3.5 A breach or violation of any of the Terms will result in an immediate termination of your Services.
3.6 We cannot be held responsible if this information is missed. We cannot be held responsible if the item you ordered is out of stock, if this is the case we will refund you as soon as possible.
4. DELIVERY, CUSTOMS & DUTY
4.1 We use third-party delivery couriers such as Royal Mail, Evri, Yodel, DHL, UPS, FedEx, USPS, PostNL, Colissimo, Swiss Post and many other courier companies, we are not responsible for any delays, damages, or losses of packages/products/orders as it’s not within our control. We are not obliged but will try to provide the best support and cooperation to help you recover the loss, damage, or delay of your packages/orders from the courier.
4.2 The majority of international orders are not subjected to Customs and Duty Tax. However, in some cases, you may be required to pay import Tax and Duties. This is your responsibility and we cannot be held responsible for any Tax and Duties fees.
4.3 We use direct local delivery services, therefore, your tracking number will only show updates when your packages arrive in the destination country and are handed to the local couriers. We don’t accept claims of loss or refunds until the estimated delivery days (including the extra days) have passed. If estimated delivery days (including the extra days) are passed and your package isn’t delivered, your order is eligible for a full refund.
4.4 We’re based in Asia and all of our products are shipped from China, Hong Kong & Singapore.
4.5 All lost orders with no proof of delivery are eligible for a full refund/replacement within 30 working days after the estimated delivery days of the receiving country.
4.6 For all refunds issued, please allow up to 2 – 7 working days for your refund to be processed and cleared back into your account.
4.7 We’re not responsible for checking delivery addresses, It’s your responsibility to ensure that you’ve put the correct delivery address on your order. If your order is lost or delivered to the wrong address as a result of you not putting the correct delivery address, we won’t be able to make changes or refunds.
4.8 If your orders are to be delivered to a safe place/neighbour, you will bear the responsibility for any losses or damages. If your order/package is delivered to a safe place/neighbour, we’re not responsible for any losses or damages and are not obligated to provide you with replacements, exchanges or refunds.
4.9 We will provide full support and all requested information to help you receive your compensation from couriers. We don’t receive courier compensation since we use third-party services and are therefore not obligated to pay for the courier compensation, it’s your responsibility to contact the courier and request your compensation.
4.10 You can’t make reports or claims of damaged packages/products after 14 days of receiving them.
5. RETURNS, EXCHANGES & REFUNDS
5.1 Returns and exchanges are accepted within 14 days of receiving orders. Your returns/exchanges request will first be reviewed, once your return/exchange request is approved you will need to follow our returns/exchanges steps and guide shown on our Delivery & Returns page.
5.2 The following terms apply to all returns and exchanges:
– Customers are responsible for the returns/exchanges shipping fees.
– Returns/exchange packages without a tracking number cannot be processed for refunds or exchanges.
– We strongly suggest using a fully tracked and traced service to ensure your return/exchange gets back to us safely as we don’t offer refunds/exchanges for lost packages.
– We do not accept returns on previously exchanged items.
– We only accept exchanges once per item, we don’t accept exchanges on previously exchanged items.
– All exchange items must be of equal value to the item originally purchased.
– We cannot accept returns/exchanges on used products (if used products are received by our warehouse, your returns/exchange will be terminated and only 50% of the product cost minus shipping fees of £4 per item will be refunded).
– Returns/exchanges without its original packing box and all original packing materials are NOT accepted.
– All Returns/exchange requests without all original packaging materials and boxes are automatically rejected. If your returns/exchanges are missing original packaging, parts or boxes when received by our warehouse, you will receive a partial refund of 50% of the product cost minus shipping fees of £4 per item.
– If additional items are returned that were not listed on your return/exchange request, a refund or exchange will not be issued.
– Original shipping and handling costs are non-refundable (£4 per item).
– Refunds will be credited to the original form of payment minus the cost of the shipping fee (£4 per item).
– If your original amount of exchange value doesn’t match your requested exchange value, you will receive a coupon for your exchange value and the coupon will not have an expiry date and is valid for life.
– After your return/exchange request is approved, you will have a returns period of 14 days. If we do not receive your tracking number within 14 days of submitting the request, your return/exchange will be automatically cancelled and can no longer be requested again.
– If we’re required to pay customs and tax fees on returns & exchange packages the fee amount will be deducted from the refund amount.
– Returns/exchanges are not accepted for all ‘custom’ or ‘made to order’ products.
– All Returns & exchanges must be returned to our returns warehouses in China or Hong Kong.
– Returns/refunds/exchanges are not accepted for all orders over 14 days of receiving orders/products. All returns/exchanges, claims, reports of cancellations, and refund requests made after 14 days of receiving products/orders are automatically rejected.
5.3 For all returns, please allow up to 14 working days for your order to be received by our warehouse and 2 – 7 working days for your refunds to be processed and cleared back into your original payment method.
5.4 For all exchanges, please allow up to 14 working days for your orders to be received by our warehouse and another 14 working days (including extra days) for your exchange to be delivered to you (excluding delays and public holidays).
5.5 For all refunds issued, please allow up to 2 – 7 working days for your refund to be processed and cleared back into your account.
5.6 DO NOT RETURN ORDERS TO THE RETURN ADDRESS SHOWN ON THE PACKAGE LABEL, OUR RETURN & EXCHANGE HUB IS A DIFFERENT ADDRESS. We are not responsible for any orders sent to the addresses shown on the delivery labels as this address is the courier facility centre and not our returns & exchange hub address, therefore, we cannot offer any refunds or exchanges for these orders sent to the wrong addresses.
5.7 Cancellations and refunds are accepted within 24 hours of your order. Cancellations and refunds are not eligible for packed orders (Order status is “PACKED”).
5.8 Orders rejected to be delivered by customers and returned to us will be refunded, however, the shipping fees will be non-refundable and deducted from the refund amount, the shipping fees will be advised by a member of our staff.
5.9 All faulty orders reported within 5 days after receiving the order are eligible for a refund/replacement. You will be asked to upload a clear image of the issue to be eligible for a refund/replacement. Please note that extra stitching, extra leather edge finish, a couple of missing minor crystals and no straight straps (that can be straightened) can’t be reported as faulty. Orders reported after the 5 days period are not eligible for faulty replacements/refunds under any circumstance. Faulty reports without evidence (clear pictures of the faults) are not considered eligible reports.
5.10 Please also note that although we have tried to represent our shades as accurately as possible, the actual colours you see will depend on the screen of the device you’re using, therefore colour inaccuracy can’t be reported as faulty.
5.11 Gift cards are non-returnable/non-refundable or exchangeable.
5.12 Coupons can’t be requested to be refunded.
6. ACCURACY & COMPLETENESS OF INFORMATION
6.1 We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.
6.2 We try to provide as accurate as possible information on this website and be as transparent as possible however, we are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.
7. MODIFICATIONS TO THE SERVICE AND PRICES
7.1 Prices for our products are subject to change without notice.
7.2 We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
7.3 We shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
8. PRODUCTS OR SERVICES (IF APPLICABLE)
8.1 Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.
8.2 We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any colour will be accurate and are not responsible for this.
We reserve the right but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction.
8.3 We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
8.4 We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected. Any orders that become out of stock after purchase/fulfillment in error are to be refunded and we cannot be held responsible for this error.
9. ACCURACY OF BILLING AND ACCOUNT INFORMATION
9.1 You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address, credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
9.3 We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
10. ERRORS & INACCURACIES
10.1 Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
10.2 We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website should be taken to indicate that all information in the Service or on any related website has been modified or updated.
11. USING OUR CONTENT
11.1 Social media influencers and third parties are allowed to use our videos and images with the following conditions only:
– MUST Tag our Social Media accounts with a clickable link with any content (including pictures and videos) they use
– DO NOT claim the images or videos as their own
– DO NOT censor our branding in the videos or images
– DO NOT edit the videos and images to change their original concepts
11.2 Our content can only be used under these conditions, using our content without following these conditions will be treated as a breach of our terms and conditions.

13. PROHIBITED USES
13.1 In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. 14.2 We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.
14.3 We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.
You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.
14.4 In no case shall Kiana Celeen, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

15.1 You agree to indemnify, defend and hold harmless Kiana Celeen and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference or your violation of any law or the rights of a third-party.
16. TERMINATION
16.1 These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
16.2 If in our sole judgment, you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
17. USER FEEDBACK, COMMENTS AND OTHER SUBMISSIONS
17.1 We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.
17.2 You agree that your comments will not violate any right of any third party, including copyright, trademark, privacy, personality, or another personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any comments.
